Terms & Conditions

1 About us
Monthly Blooms is provided by Emily Nightingale trading as Nightingale Florals & Events, based in Willington, Derbyshire. Contact us about orders, changes or complaints at emily@nightingaleflorals.com.
Business and correspondence address: 3 Repton Road, Willington, Derbyshire, DE65 6BX

2 Your subscription and payment
Each subscription includes one florist’s choice bouquet per month and local delivery to an eligible address. The price is £35 per bouquet, including delivery and any applicable taxes. Packages are £105 for three deliveries, £210 for six deliveries or £420 for twelve deliveries.

Payment for the full package is due when you order. “£35 per month” describes the cost of each monthly delivery; it is not an instalment payment plan. Your subscription ends after the purchased number of deliveries and does not renew automatically.

Your order is accepted when we confirm acceptance, your delivery address and starting month in writing. An automated payment receipt alone is not acceptance. If we cannot accept your order, we will return any payment in full. The price of an accepted prepaid subscription will not increase during its term.

3 Your monthly flowers
Bouquets are florist’s choice. We select seasonal flowers and foliage, so varieties, colours and stem numbers vary with availability. Photographs illustrate our style rather than guaranteeing an exact bouquet. Each bouquet will match the advertised description and quality; substitutions will be of comparable quality and value.

Flowers arrive wrapped with flower food and care instructions. A vase is not included. Some flowers may arrive in bud. Please discuss any essential flower exclusions before ordering; these apply only if we confirm them in writing.

4 Gifts and starting dates
Please provide the recipient’s name, full delivery address and postcode, contact details, preferred starting month and any gift message. For Christmas gift subscriptions, a gift certificate is included and deliveries begin in January unless a different start is agreed in writing. We will confirm how the certificate will be supplied.

The certificate records the subscription already purchased and is not a separate cash voucher. The purchaser remains our customer; recipients may contact us about delivery or flower quality.

Delivery and changes
5 Delivery area
Delivery is included within a five-mile radius of our Willington base. This is a straight-line radius, not a five-mile driving route. Eligibility depends on the full delivery address, which must be checked before ordering or accepting a change of address.

Nearby places may include Repton, Findern, Egginton, Etwall, Hilton, Burnaston, Milton, Newton Solney, Bretby, Ingleby, Rolleston on Dove, Stretton, Barrow upon Trent, Swarkestone and Ticknall. A named village does not guarantee every address is covered. If an order is placed for an ineligible address, we will agree an eligible alternative or refund any payment for deliveries we cannot provide.

6 Delivery dates
We deliver on the first Tuesday of each month, beginning in the starting month confirmed with your order. Delivery times vary with our route; a particular time slot is not guaranteed unless agreed in writing.

If a bank holiday, severe weather, illness, road closure or supply disruption affects delivery, we will tell you as soon as reasonably possible. We will offer an alternative date. If no suitable alternative can be agreed, we will refund the affected delivery. If we cannot fulfil the remaining subscription, we will refund all undelivered bouquets. This does not limit any other legal remedy you may have.

7 If the recipient is not home
Please ensure someone can receive the flowers, or provide clear instructions for an authorised neighbour or a sheltered, secure safe place. We will only leave flowers with a neighbour or in a safe place where you or the recipient have authorised this and the location is suitable.

If we cannot safely deliver, we will try to contact you or the recipient and explain the available collection or redelivery arrangements. Any additional redelivery charge must be disclosed and agreed before it is incurred. We will not charge for redelivery caused by our own mistake.

An incorrect address, lack of access or a missed delivery does not automatically entitle us to retain the full payment. Any charge for a failed delivery will reflect reasonable, unavoidable losses actually incurred, taking account of costs saved or flowers reused. We remain responsible where we fail to follow agreed delivery instructions.

8 Address changes and holidays
Please request an address change, pause or gift transfer by email at least seven calendar days before the scheduled delivery. A change is effective only when we confirm it in writing. A replacement address must be within our delivery area.
Where a pause is agreed, the postponed bouquet moves to the next agreed monthly delivery date and the subscription end date extends accordingly. We will try to accommodate later requests, but flowers may already have been ordered or prepared. We will explain any reasonable unavoidable cost before agreeing a late change.

Cancellations and customer care
9 Cancelling a subscription
Fresh flowers are perishable and the usual statutory 14-day change-of-mind cancellation right generally does not apply to their supply. This does not remove your rights where flowers are faulty, not as described or not delivered as agreed, or any cancellation right that otherwise applies by law.
In addition, our voluntary policy allows the purchaser to cancel future deliveries by emailing us. If we receive notice at least seven calendar days before the next scheduled delivery, we will refund that delivery and all later undelivered bouquets at £35 each.

For shorter notice, any deduction for the next delivery will be limited to reasonable, unavoidable costs already incurred that cannot be recovered, allowing for any savings or reuse. We will explain the deduction, which cannot exceed £35 for that delivery. Later undelivered bouquets will be refunded in full. There is no separate cancellation administration fee.
Refunds will be made to the purchaser’s original payment method within 14 days of cancellation or agreement that a refund is due, unless the law requires an earlier refund.

10 Flower quality and complaints
Please contact us as soon as possible if flowers arrive damaged, are missing or fall below the promised quality. Ideally tell us within 48 hours and include your order details and photographs where possible, so we can investigate while the flowers are fresh. This is a request to help resolve the issue, not a deadline that removes your legal rights.

We will provide the refund, replacement or other remedy required by consumer law. You do not have to accept store credit instead of a refund where a refund is due. Please contact us before returning flowers so we can agree suitable arrangements; we will cover reasonable return costs where goods are faulty.

Flower life varies by variety, season and care. Please follow the supplied instructions, use a clean vase and fresh water, and keep flowers away from direct heat. Poor care may affect a claim where it caused the problem, but will not excuse a fault present at delivery.

11 Flower safety and personal information
Flowers and foliage are decorative and must not be eaten. Some varieties may be harmful to pets or people, and flowers can contain pollen or fragrance. Keep flowers and flower food away from children and pets. We cannot promise a pet-safe or allergen-free bouquet unless expressly agreed before ordering.

We use purchaser and recipient information to process orders, provide deliveries and handle customer enquiries, as explained in our Privacy Policy. Please provide only the recipient details needed for the gift. Buying a gift does not automatically subscribe the recipient to marketing.

12 Your rights and changes to these terms
We are responsible for foreseeable loss caused by our breach of these terms or failure to use reasonable care and skill. We do not exclude liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded.

The terms supplied when your order is accepted apply to that subscription. Later changes apply to new orders unless you agree otherwise or a change is required by law. These terms are governed by English law, without removing mandatory consumer protections or court rights available where you live. Please contact us first so we can try to resolve any concern.
